Elon Musk is escalating his legal battle against OpenAI by taking the case to the U.S. Court of Appeals. The lawsuit, which Musk initiated in 2024, accuses OpenAI executives of straying from their initial mission of developing artificial intelligence for the greater good and instead focusing on personal gain.
The recent decision by a California jury to dismiss the case on a technicality regarding the statute of limitations has not deterred Musk from pursuing justice. Despite the court’s ruling, Musk remains steadfast in his belief that OpenAI CEO Sam Altman and President Greg Brockman violated the public trust by shifting the organization from a charity to a profit-driven enterprise.
In a statement following the verdict, Musk reiterated his position that Altman and Brockman had enriched themselves at the expense of the original OpenAI charity. He emphasized that the timing issue does not change the fundamental facts of the case, and he is determined to hold the executives accountable for their actions.
Musk’s legal team has made it clear that the lawsuit is not about personal financial gain for the billionaire. Instead, Musk is seeking to have Altman and Brockman removed from their leadership roles and to compel OpenAI to return billions of dollars in profits back to the original charitable foundation.
During the trial, Musk testified that his early financial support for OpenAI was contingent on the organization remaining a transparent, non-profit entity dedicated to advancing AI for the benefit of humanity. He argued that OpenAI’s pivot towards commercial partnerships, such as the lucrative deal with Microsoft, betrayed the core principles on which the organization was founded.
The timing of the court’s decision coincides with a period of significant growth for Musk’s other ventures. His AI company, xAI, recently merged with SpaceX, boosting the rocket company’s valuation to $1.25 trillion. SpaceX is now gearing up for an impending IPO, with its financial prospects set to be made public in the coming weeks.
Despite the setback in the courtroom, Musk remains resolute in his pursuit of justice against OpenAI. The case may have hit a roadblock, but Musk’s determination to hold the executives accountable for their actions shows no signs of waning.
